Your right of withdrawal as a consumer

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period shall be 14 days from the day on which you or a third party other than the carrier designated by you takes possession of the goods.

To exercise your right of withdrawal, you must inform us (FairyFly GmbH, Mühlenstr. 8A, 14167 Berlin, email: kontakt@fairyfly.de ) of your decision to withdraw from this contract by means of a clear statement (e.g., by letter or email). You may use the sample withdrawal form below, but this is not mandatory.

To meet the cancellation deadline, it is sufficient for you to send your notification of your exercise of the right of cancellation before the cancellation period has expired.

Consequences of revocation

If you cancel this contract, we will reimburse you all payments that we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), promptly and at the latest within 14 days from the day on which we received notification of your cancellation of this contract.

For the refund, we will use the same payment method you used for the original transaction, unless expressly agreed otherwise with you. Under no circumstances will you be charged any fees for this refund.

We may refuse to refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us promptly and in any event no later than 14 days from the date on which you notify us of the cancellation of this contract. This deadline is met if you send the goods before the expiry of the 14-day period.

You shall bear the direct costs of returning the goods.

Exclusion of the right of withdrawal for live beneficial organisms

According to Section 312g Paragraph 2 No. 2 of the German Civil Code (BGB), the right of withdrawal does not apply to contracts for the delivery of goods,

• which can spoil quickly or whose expiration date would be quickly exceeded,
• which are not prefabricated and for whose production an individual selection or determination by the consumer is decisive,
• or which are clearly tailored to the personal needs of the consumer.

This particularly applies to the following products from our range:

• Living beneficial organisms (e.g. parasitic wasps, predatory mites, nematodes),
• Trichogramma cards with live parasitic wasp eggs,
• Nematode preparations with live roundworms,
• Predatory mites and other biological antagonists,

Exceptions and warranty

Even if the right of withdrawal is excluded for live beneficial organisms, your statutory warranty rights in the event of defects or incorrect deliveries remain unaffected. This applies in particular to:

• Delivery of dead or non-viable beneficial organisms (please provide photo evidence),

• Delivery of incorrect products due to a shipping error,

• Transport damage with demonstrable damage to the packaging,

• significant delay in delivery, provided that the use of the beneficial organisms is no longer possible or sensible.

In these cases, you are entitled to a free replacement. For live beneficial insects, the statutory warranty applies. Please inspect the delivery immediately upon receipt. Obvious defects (e.g., dead or non-viable beneficial insects) should be reported by email and with a photo as soon as possible – ideally within 24 hours of delivery. Your statutory warranty rights remain unaffected.

For non-living products (such as accessories, books or other aids), the statutory right of withdrawal applies without restriction in accordance with the above provisions.
